1. Introduction
This Developer Tools Acceptable Use Policy ("Policy") governs your access to and use of the software, application programming interfaces (APIs), software development kits (SDKs), documentation, as well as all accompanying and related source code, executables, content, and any other associated materials provided by Austin Artificial Intelligence, Inc. (collectively, the "Developer Tools").
By accessing or using our Developer Tools, you, on behalf of yourself and any entity you represent ("Client" or "You"), agree to be bound by this Policy. If you do not agree to this Policy, you may not use the Developer Tools.
2. Prohibited Uses
Your use of the Developer Tools is conditioned on your adherence to the restrictions outlined in this section. You agree that you will not, and will not permit any third party (including your end-users) to, use the Developer
Tools to:
2.1. Illegal, Harmful, or Fraudulent Activities
- Engage in, promote, or facilitate any activity that is illegal under applicable local, state, national, or international law. This includes, but is not limited to, activities related to:
- Child pornography or exploitation.
- Terrorism or violence.
- Fraud, phishing, pyramid schemes, or any other financial crime.
- Illegal gambling, trafficking, or trade.
- Distribute, store, or transmit any malware, viruses, worms, Trojan horses, or other malicious or destructive code.
- Send unsolicited commercial communications, promotions, or advertisements (spam).
- Infringe upon or misappropriate the intellectual property rights of any third party, including copyright, patents, trademarks, or trade secrets.
- Violate the privacy, publicity, or other personal rights of others, including the collection or processing of personal data in violation of applicable privacy laws (e.g., GDPR, CCPA).
- Engage in defamation, harassment, libel, threatening behavior, or hate speech.
2.2. Security and Network Integrity
- Attempt to gain unauthorized access to, or disrupt the integrity, security, or performance of, our services, systems, or data.
- Conduct vulnerability scanning, penetration testing, or any form of security assessment on our network or systems without our express prior written consent.
- Use the Developer Tools to create, benchmark, or develop a service that is competitive with Austin Artificial Intelligence, Inc.'s offerings.
- Interfere with or circumvent any security features, rate limits, or usage restrictions implemented by Austin Artificial Intelligence, Inc.
2.3. Misuse of the Developer Tools
- Reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Developer Tools, except to the extent that this restriction is expressly prohibited by applicable law.
- Resell, sublicense, lease, or otherwise distribute the Developer Tools to any third party.
- Remove, obscure, or alter any proprietary notices (including copyright and trademark notices) on the Developer Tools.
- Use the Developer Tools in any manner that places an excessive or disproportionate load on our infrastructure.
- Misrepresent your identity or the identity of Your Application when using the Developer Tools.
3. Your Responsibilities
You are solely responsible for:
- Your Application and any content, data, or information transmitted through it.
- Ensuring that Your Application and its use comply with this Policy and all applicable laws.
- Maintaining the security of your API keys, access tokens, and any other credentials. You are responsible for all activities that occur using your credentials.
4. Enforcement and Consequences of Violation
Austin Artificial Intelligence, Inc. reserves the right to investigate any potential violation of this Policy. If we determine, in our sole discretion, that a violation has occurred, we may take any of the following actions without
prior notice:
- Issue a warning.
- Suspend or revoke your access to the Developer Tools.
- Terminate your agreements with Austin Artificial Intelligence, Inc.
- Report the activity to appropriate law enforcement authorities.
- Take any other legal or technical action we deem appropriate.
We will not be liable for any damages of any kind incurred by you or any third party as a result of any enforcement action taken in response to a violation of this Policy.
5. Changes to This Policy
Austin Artificial Intelligence, Inc. reserves the right to modify this Policy at any time. We will provide notice of any material changes by posting the updated Policy on our developer portal or by other means of communication. Your continued use of the Developer Tools after the effective date of any changes constitutes your acceptance of the new Policy.
